DoubletimeTerms of service
These terms govern your use of the AI phone and chat answering service provided by Doubletime AI LLC, a Florida limited liability company. By subscribing to the service you agree to them.
1. What the service is
We configure and operate an AI agent that answers calls and text messages at a phone number associated with your business. Depending on your configuration, the agent answers questions, books appointments into a calendar you connect, sends confirmations, forwards calls that meet criteria you set, and delivers you transcripts and summaries.
2. The agent is software, not a person
The agent is automated. It can misunderstand a caller, mis-transcribe a name or address, or book an appointment incorrectly. You are responsible for reviewing the call records and appointments we deliver. The service is not an emergency service. It must not be presented to callers as a way to reach emergency assistance, and callers with an emergency should hang up and dial 911. The agent does not give medical, legal, or financial advice, and you agree not to configure it to do so.
3. Your responsibilities
- Give us accurate business information — hours, services, pricing, service area, availability — and tell us when it changes.
- Hold the authority to forward your business phone line to us and to connect the calendar you connect.
- Comply with the laws that apply to contacting your own customers, including the TCPA and state telemarketing and call-recording laws. You are responsible for obtaining consent from your customers where consent is required. The service is not for cold outreach or marketing blasts, and you may not ask us to configure it for that.
- Keep your account credentials secure.
If you are a health care provider or otherwise handle protected health information, tell us before launch so a business associate agreement can be put in place. Do not send us protected health information outside that agreement.
4. Fees and billing
The subscription fee is stated on your order or invoice and is billed monthly in advance. Fees are non-refundable except as required by law. The service is month to month: either party may cancel with notice before the next billing date, and cancellation takes effect at the end of the paid period. We may change pricing with 30 days' written notice.
5. Suspension and termination
We may suspend or terminate the service immediately if you fail to pay, use the service unlawfully, or use it in a way that puts our telephony or AI providers' accounts at risk. On termination we will help you point your phone number back where it came from, and will provide a copy of your call records on request for 30 days, after which we may delete them.
6. Ownership
We own the software, prompts, configuration tooling, and infrastructure. You own your business information and your call records. You grant us the license needed to operate the service for you.
7. Third-party services
The service depends on providers including Twilio, OpenAI, and your calendar provider. Outages, rate limits, or policy changes at those providers can interrupt the service, and we are not liable for their failures. We do not guarantee uninterrupted or error-free operation.
8. Disclaimer of warranties
The service is provided "as is" and "as available." To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the agent will answer every call correctly or capture every booking.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, lost business, or missed appointments.
10. Indemnity
You will indemnify and hold us harmless from claims arising out of your business information, your instructions to us, your use of the service, or your failure to comply with the laws that apply to your communications with your own customers.
11. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state or federal courts located in Florida.
12. Changes
We may update these terms and will post the current version at this address. Continued use after an update means you accept it.
